Islam Question and Answer - His wife committed zina twice with a Christian man; should he divorce her? If she apostatises will there be any sin on him?

 

A man want to divorce his wife after she committed adultery for the second time with a christian man. He had forgive her the first time and now after she had travelled , she had committed adultery for the second time with another christian man but the husband this time want to divorce her because he is an Islamic teacher and he fears for his reputation. But he fears if he divorce this woman she will leave Islam and go back to Christianity and also she does not want to wear hijab but pray and fast . they have grown up children. Please advise The husband does not want to be responsible for the wife leaving Islam.

Praise be to Allaah.

Firstly: 

If a woman persists an immoral action and does not repent
from it or give it up, even if the matter did not go as far as zina, such as
if she had a relationship with this Christian man or anyone else, then it is
not permissible for the husband to keep her, because that is a kind of
cuckoldry (diyaathah), and cuckoldry is a major sin, because of the report
narrated by al-Nasaa’i (2562) from ‘Abd-Allah ibn ‘Umar (may Allah be
pleased with him) who said: The Messenger of Allah (blessings and peace of
Allah be upon him) said: “There are three at whom Allah, may He be glorified
and exalted, will not look on the Day of Resurrection: the one who is
defiant towards his parents, the woman who imitates men, and the cuckold.”

Classed as saheeh by al-Albaani in Saheeh al-Nasaa’i. 

The cuckold is the one who approves of evil conduct in his
family. 

Shaykh al-Islam Ibn Taymiyah (may Allah be pleased with him)
was asked about the one who came into his house and found a stranger with
his wife, so he gave her her dues and divorced her by talaaq, then he went
back and reconciled with her and heard that she had been found with a
non-mahram man.  

He replied: In the hadeeth from the Prophet (blessings and
peace of Allah be upon him) it says that when Allah, may He be glorified and
exalted, created Paradise, He said: “By My glory and majesty, no miser, liar
or cuckold will enter you.” The cuckold is the one who has no protective
jealousy or pride. In al-Saheeh it is narrated that the Prophet
(blessings and peace of Allah be upon him) said: “The believer has
protective jealousy (gheerah) and Allah has protective jealousy, and the
protective jealousy of Allah is that no slave should do that which is
forbidden to him.” And Allah says (interpretation of the meaning): “The
adulterer — fornicator marries not but an adulteress — fornicatress or a
Mushrikah; and the adulteress –fornicatress, none marries her except an
adulterer — fornicater or a Mushrik [and that means that the man who agrees
to marry (have a sexual relation with) a Mushrikah (female polytheist, pagan
or idolatress) or a prostitute, then surely, he is either an adulterer —
fornicator, or a Mushrik (polytheist, pagan or idolater). And the woman who
agrees to marry (have a sexual relation with) a Mushrik (polytheist, pagan
or idolater) or an adulterer — fornicator, then she is either a prostitute
or a Mushrikah (female polytheist, pagan, or idolatress)]. Such a thing is
forbidden to the believers (of Islâmic Monotheism)” [al-Noor 24:3]. The
correct scholarly opinion is that it is not permissible to marry a zaaniyah
(a woman who commits fornication or adultery) until after she has repented.
The same applies if the wife commits zina: the husband has no right to keep
her in that case; rather he should leave her, otherwise he will be a cuckold
(duyooth). End quote from Majmoo‘ al-Fataawa, 32/141

 Secondly: 

If the woman has repented, turned over a new leaf and is
living a righteous life, and she has cut off all ties to that non-mahram
man, then the husband may keep her, and perhaps Allah will reward him for
treating her kindly and concealing her sin. 

We have stated that it is not permissible for him to keep her
as his wife if she committed zina and has not repented from it sincerely,
and we stated that if she repents and turns over a new leaf, then he may
keep her and conceal her sin, if he has the patience to do that. What we
have said about it being permissible to keep her if she repents is not
obligatory for him, rather it is up to him. In all cases he may leave her,
because zina on the part of the wife is extremely abhorrent and most people
cannot forgive that. And if he divorces her, then he is not responsible for
what she commits of sin, and if she apostatises from Islam, she alone is
responsible for that, because she is accountable and of sound mind: if she
does good deeds that it is in her favour and if she does bad deeds then it
counts against her. 

We ask Allah to protect the Muslims from all trials, evils
and turmoil. And Allah knows best.

The Prophet's foster mother




Fatimah bint Asad belonged to the Hashimite clan. Her grandfather was Hashim, the Prophet's (peace be upon him) great-grandfather. When Muhammad was only eight years old, he lost his grandfather, Abd Al-Muttalib who was looking after him after he had lost both his parents. When Abd Al-Muttalib realized that he was about to die, he called his son Abu Talib and entrusted the young Muhammad to his care. Although Abd Al-Muttalib had many sons at the time, he chose Abu Talib because Abdullah, the Prophet's father, was his full brother and because he knew Fatimah to be a kindly and caring woman. She proved to be a great choice, as she looked after Muhammad as well as she looked after her own children. In order to appreciate how caring she was, we take the Prophet's own words. When she died, he prayed for her, saying: "May God have mercy on you, mother. You were my mother after my own mother had passed away. You left yourself hungry to feed me and in rags to clothe me. You deprived yourself of the best food to give it to me. Your aim was to please God".
 
When the Prophet received his message and was told to call on people to embrace Islam, Fatimah was one of the earliest people to respond. We know that her son, Ali, was one of the first four people to accept it. Fatimah is reported to have been the eleventh person to become a Muslim. Needless to say, her knowledge of the Prophet's character, whom she had brought up, was sufficient for her to realize that he, who never told a lie could not make a false claim.
 
The Prophet was the most dutiful of people. Whenever anyone did him a kindness, he would repay it in the most generous way. Fatimah immigrated to Madinah with all members of the Prophet's household, except his daughter Zainab who remained with her husband. Fatimah was a widow at the time. The Prophet used to visit her at home, and would even have an afternoon nap in her home. It was not long after their settlement in Madinah that her son, Ali, married the Prophet's own daughter Fatimah. Thus she became the Prophet's daughter's mother-in-law. She was very kind to her and helped her in every way she could.
 
When the Prophet had something to give as a present he did not omit to give her a share, treating her in the same way as he treated his own daughter. Once the Prophet was sent a suit made of velvet. He would not wear that, as he did not like to wear luxurious clothes. He gave the suit to Ali and told him: "Make it as scarves and give it to the Fatimahs."
 
Ali mentioned that he made four scarves: One for his mother, Fatimah bint Asad, one for his wife, Fatimah bint Muhammad, and one for his cousin Fatimah bint Hamzah, and the last for his sister-in-law, Fatimah bint Shaibah, Aqeel's wife.
 
When Fatimah bint Asad died, the Prophet prayed for her as we have already mentioned. He took part in preparing her for burial, pouring the water over her body for her final bath. He took off his shirt and put it on her, wrapping her body with a suitable cover above it. He took part in preparing her grave. He even lay in it. He then said: "It is God who gives life and causes death. He is the One who is always alive and never dies. My Lord, forgive my mother Fatimah bint Asad her sins, grant her proof, make her entrance wide. I appeal to You by the truth of Your messengers and the Prophets before me. You are the most merciful."
 
The Prophet was asked why he did those things for Fatimah bint Asad. He answered: "Next to Abu Talib no one was more kindly to me than her. I dressed her in my shirt so that she would be given suits from heaven, and I lay in her grave so as to make her last dwelling easier for her."

Praise be to Allaah, we seek His help and His forgiveness. We seek refuge with Allaah from the evil of our own souls and from our bad deeds. Whomsoever Allaah guides will never be led astray, and whomsoever Allaah leaves astray, no one can guide. I bear witness that there is no god but Allaah, and I bear witness that Muhammad is His slave and Messenger.

Uttering the Intention to fast out loud is an Innovation (Bidah)

 In India we make the niyah of Saum as "ALLAH HUMMA ASOOMO JADAN LAKA FAGFIRLEE MA KADDAMTU WA MA AKHARTU", I am not sure of the meaning, but is it the right niyah ?




The Ramadaan fast and other acts of worship are not valid unless accompanied by the proper intention, because the Prophet (peace and blessings of Allaah be upon him) said: "Actions are but by intentions, and everyone shall have but that which he intended…" (Narrated by al-Bukhaari, 1; Muslim, 1907)

The intention is subject to the condition that it be made at night, before the dawn comes, because the Prophet (peace and blessings of Allaah be upon him) said: "Whoever does not intend to fast before dawn, there is no fast for him." Narrated by al-Tirmidhi, 730.

According to a version narrated by al-Nasaai (2334): "Whoever does not intend to fast from the night before, there is no fast for him." Classed as hasan by al-Albaani in Saheeh al-Tirmidhi, 573.

What is meant is that whoever does not intend to fast and resolve to do so from the night before, his fast is not valid.

The intention (niyyah) is an action of the heart. The Muslim should resolve in his heart that he is going to fast tomorrow. It is not prescribed for him to utter it out loud and say, "I intend to fast" or "I will fast tomorrow" or other phrases that have been innovated by some people.
The correct intention is when a person resolves in his heart that he is going to fast tomorrow. 


Hence Shaykh al-Islam Ibn Taymiyah said in al-Ikhtiyaaraat (p. 191): 
If it crosses a persons mind that he is going to fast tomorrow, then he has made the intention. 
The Standing Committee was asked: 
How should a person intend to fast Ramadaan? 
They replied: 
The intention is done by resolving to fast.
It is essential that the intention to fast Ramadaan be made every night or having 1 intention to fast entire Ramadhaan..
